ONIT

To the maximum extent permitted by law, you irrevocably waive, release, and forever discharge ONIT, its affiliates, officers, directors, employees, representatives, partners, agents, successors, and assigns (collectively, the “Released Parties”), from any and all claims, demands, damages, losses, liabilities, disputes, costs, and expenses of any kind, whether known or unknown, foreseeable or unforeseeable, arising out of or related to the use of the ONIT platform and the presence, conduct, or actions of any Worker on or near your property.

This waiver explicitly includes, without limitation, any liability for:

• Theft, burglary, or robbery, including stolen property, personal belongings, tools, electronics, cash, identity documents, or credit card data;

• Vandalism, intentional and unintentional property damage, arson, or accidental destruction, including fire, flooding, broken fixtures, or damage to appliances, vehicles, landscaping, or structures;

• Intentional or negligent property damage or destruction, including but not limited to :

  • Structural damage to any part of the home or premises (walls, ceilings, floors, windows, doors, foundations, utilities, roofing, plumbing, or electrical systems);

  • Damage to fixtures, appliances, tools, décor, or furnishings;

  • Harm to landscaping, fencing, vehicles, outbuildings, or outdoor amenities;

  • Spills, stains, fire, water, chemical, or biohazard contamination;

  • Any cleanup, restoration, or remediation costs resulting from Worker actions or omissions;

• Personal injury, wrongful death, or medical emergencies suffered by any individual on the premises, whether the Worker, homeowner, household member, pet, or guest;

• Assault, battery, sexual misconduct, harassment, stalking, or intimidation by any Worker;

• Kidnapping, unlawful restraint, or abuse (verbal, physical, or sexual) of any individual in the home, including children, elders, or vulnerable persons;

• Workers under the influence of drugs, alcohol, or controlled substances, or exhibiting violent, erratic, or unstable behavior;

• Workers bringing unauthorized individuals, accomplices, or weapons onto the property;

• Negligence, incompetence, or unskilled work, including tasks performed incorrectly, dangerously, or resulting in subsequent hazards;

• Deception, impersonation, or misrepresentation, including fake identities, fraudulent certifications, or misstatement of skills or intentions;

• Violation of homeowner privacy, including unauthorized photography, video, data collection, or social media posts;

• Injury to animals or destruction of pet property while on the premises;

• Medical issues arising from exposure to allergens, communicable diseases, or hazardous substances introduced or mishandled by the Worker;

• Failure to complete or abandon tasks, including negligence in duty or damage caused by incomplete work;

• Trespassing before or after the scheduled job, unauthorized return visits, or refusal to leave the premises;

• Disputes over payment, time worked, or services rendered, whether direct or indirect;

• Any other act, omission, condition, or consequence—whether criminal, negligent, reckless, accidental, or intentional—related to the Worker’s presence on your property.

You acknowledge that ONIT does not vet, monitor, supervise, insure, or control any Worker and that you accept full responsibility for inviting them into your home or onto your property. You agree that ONIT bears no legal, financial, or moral responsibility whatsoever for any Worker’s behavior, and that all risks associated with hiring, admitting, interacting with, or relying on a Worker are yours alone.

This waiver is intended to be interpreted as broadly and comprehensively as permitted by Connecticut law, and you agree that you are voluntarily assuming all risks, including those arising from negligence.
